The Department of Homeland Security and the Justice Department's Executive Office for Immigration Review filed a final rule October 9, scheduled to publish and take effect October 14. It finalizes a 2025 interim rule on civil penalties for not departing as ordered or entering unlawfully. An appeal must be postmarked within 15 business days of service. The one change lets ICE accept a late appeal when it finds a documented mail delay was beyond the person's control.
