CPSC interprets 'flammable liquid fuels' not to include fuel additives, so containers meant only for them fall outside the gas-can flame-mitigation requirement
The Consumer Product Safety Commission issued an interpretive rule reading 'flammable liquid fuels' in the 2020 portable fuel container law not to include fuel additives intended to be added to those fuels for the sole purpose of improving engine performance, cleaning engine components, extending engine life, stabilizing fuel, preventing weather effects from fuel, or some similar purpose unrelated to creating heat or power. It was published October 19 and took effect that day. Staff estimate it avoids approximately $545.7 million in annual compliance costs.
