The Federal Communications Commission published a notice October 19 that asks for comment on whether the construction of communications facilities connected with a spectrum license is an 'undertaking' requiring review under section 106 of the National Historic Preservation Act, or an 'agency action' requiring review under the Endangered Species Act. The notice adopts no rule; it only seeks comment, and it proposes no end to tribal consultation. Comments, identified by WT Docket No. 25-217, are due November 18, 2026, and reply comments December 3, 2026.
